The general terms applying to use of this website and web-design work supplied by Kilwhiss Online.
Company details: Kilwhiss Group Limited, registered in Scotland under company number SC886888, operates this website. Registered office: Easter Kilwhiss Farm, Ladybank, Cupar, Scotland, KY15 7UR (correspondence only; no customer visits).
Website use
This website provides general information about Kilwhiss Online and its services. You may use it only for lawful purposes and must not attempt to damage, disrupt, probe or gain unauthorised access to the website or its supporting systems.
Proposals and agreement
No project begins until scope, pricing, responsibilities and delivery terms have been confirmed in writing. A proposal, statement of work or order may add to or vary these general terms. Where there is a conflict, the project-specific written agreement takes priority.
Web-design projects
Pages, features, content responsibilities, revision rounds, testing, launch work and support are limited to the agreed scope. Search position, traffic, conversion, load time and commercial return cannot be guaranteed. Hosting, domains, premium plugins, licences, photography, copywriting and ongoing maintenance are separate unless expressly included.
Customer responsibilities
You are responsible for providing accurate instructions, timely decisions, authorised content and suitable access. You must have permission to use all text, images, trademarks, data and other material supplied for the project. Delays in providing required material or approval may affect the delivery timetable.
Changes and additional work
Requests outside the agreed scope may require a revised price and timetable. Additional work will not be treated as included merely because it is related to the original project.
Fees and payment
Prices, deposits, stages, taxes and payment dates are stated in the proposal or invoice. Work may be paused when an undisputed payment is overdue. Third-party charges and renewals remain the customer’s responsibility unless the written agreement states otherwise.
Review and acceptance
You must review work and report material issues within the period stated in the proposal. The website may be treated as accepted when written approval is given, it is put into live use, or the stated review period ends without a material issue being reported.
Intellectual property
Pre-existing tools, methods, reusable code, themes, plugins and third-party materials remain subject to their existing ownership and licences. Ownership or licence of project-specific design and content will be stated in the proposal and normally depends on full payment of all related invoices.
Third-party services
WordPress, hosting platforms, domain registrars, payment providers, plugins, APIs and other external services operate under their own terms and may change or become unavailable. Kilwhiss Online is not responsible for a third party’s independent service, pricing, security or availability.
Security and backups
Reasonable security practices are used within the agreed scope. No website can be guaranteed immune from faults or attack. Ongoing updates, monitoring, backups and incident response are included only where a care or hosting agreement expressly provides them.
Confidentiality and data protection
Each party will use reasonable care with confidential information received for the project. Personal information is handled according to the Privacy Policy and any project-specific data-processing terms.
Cancellation and suspension
Cancellation rights, notice and charges are governed by the project agreement and applicable law. Work completed, committed third-party costs and reserved delivery time may remain payable. Service may be suspended for material breach, unlawful use, security risk or overdue payment after reasonable notice where appropriate.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that restriction and any project-specific agreement, Kilwhiss Online is not responsible for indirect or consequential loss, loss of profit, loss caused by customer-supplied material, or failure of third-party services. Any agreed liability limit will be stated in the applicable proposal or contract.
Governing law
The governing law and courts are those stated in the project agreement. If the agreement does not specify them, the laws of Scotland apply and the Scottish courts have jurisdiction, subject to any mandatory consumer rights.
